1. Respect for Copyright
Neon Kiss (the "Service") respects the intellectual-property rights of others and expects users to do the same. This Policy describes how copyright owners can report content they believe infringes their rights, in line with the U.S. Digital Millennium Copyright Act (DMCA) and similar laws.
2. Filing a Takedown Notice
If you believe content on the Service infringes your copyright, send a written notice to our designated agent at hello@neonkiss.ai with the subject line "DMCA Notice". Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim was infringed.
- Identification of the material you claim is infringing, with enough detail for us to locate it (for example, a link).
- Your contact information (address, telephone number, and email).
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf.
3. Our Response
On receiving a valid notice, we will remove or disable access to the material and make a reasonable effort to notify the user who provided it. We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
4. Counter-Notice
If you believe your content was removed by mistake or misidentification, you may send a counter-notice to hello@neonkiss.ai with the subject line "DMCA Counter-Notice". It must include:
- Your physical or electronic signature.
- Identification of the material and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the complaining party.
We may restore the material after a waiting period unless the copyright owner files a court action.
5. Misrepresentations
Under the DMCA, any person who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. Please make sure your claims are accurate before submitting them.
